Warranty Information

Limited Product Warranty

Custom Medical Specialties ("CMS") warrants that its medical products are free from defects in materials and workmanship under normal use and conditions. This warranty applies only to products purchased directly from CMS or through authorized distributors.

Warranty Coverage

• Products are warranted to be free from manufacturing defects
• Products conform to specifications as stated in product documentation
• Products are manufactured in compliance with FDA regulations and quality standards

Warranty Period

The warranty period begins on the date of shipment and extends for the shelf life or expiration date printed on the product packaging, whichever is applicable to the specific product type.

Exclusions and Limitations

This warranty does NOT cover:

• Products that have been improperly stored, handled, or used
• Products that have been modified, altered, or damaged after shipment
• Products used beyond their expiration date
• Products damaged due to improper sterilization methods
• Normal wear and tear from routine use
• Damage caused by accident, misuse, abuse, or negligence
• Products used in ways not specified in product instructions

Warranty Claims

To make a warranty claim, please contact our customer service team:

Required Information for Claims

• Product name and catalog number
• Lot number and expiration date (if applicable)
• Date of purchase and invoice number
• Description of the defect or problem
• Photographic evidence of the defect (if possible)

Remedies

If a product is found to be defective under this warranty, CMS will, at its sole discretion:

• Replace the defective product with a comparable product at no charge
• Issue a credit for the purchase price of the defective product
• Repair the defective product (where applicable)

Customer is responsible for return shipping costs unless otherwise agreed upon by CMS.

Disclaimer of Other Warranties

THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CMS makes no other warranty of any kind whatsoever, express or implied.

Limitation of Liability

CMS'S LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE PURCHASE PRICE OF THE DEFECTIVE PRODUCT. In no event shall CMS be liable for:

• Consequential, incidental, special, or indirect damages
• Loss of profits, revenue, or data
• Cost of substitute products or services
• Property damage or personal injury
• Claims by third parties

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

While this warranty defines our legal obligations, our commitment to quality goes beyond these terms. We manufacture all products in our ISO-certified clean room facilities following strict quality control procedures and FDA compliance standards. Every product undergoes rigorous inspection before shipping.
